Understanding UBE/UCE

• Stands for Unsolicited Bulk Email/Unsolicited Commercial Email. In other words defines what spam means. This is the general definition for spam that is accepted and used by companies like Spamhaus.

• Sending Bulk email by itself is not considered as spam. This means that it may be possible for somebody to send a hundred thousand emails to email addresses and there may not be a problem.

• However, the problem will start when these emails are unsolicited i.e. people who are getting them didn't ask for them.

• The action will cause a reaction i.e. people who hate spam will start hitting "This is spam" or equivalent button in their email/webmail accounts.

• The ISPs/ESPs will soon find out and if they get more than one such instances, then they will try to get the IP address/addresses that are sending those emails blacklisted.

• Also the contents will be noted by the spam filters and possibly the URLs in the email may also get blacklisted.

• The next time if the same sender tries to send emails to same recipients or even new recipients, the chances are that they will be bounced back/end up in spam folders/deleted without any warnings.

Re-iterating the Consequences of Using a Purchased List:

• A purchased list contains a list of email addresses whose owners have not provided explicit permission to the buyer of the list to send them any emails.

• In order for you to prove that these email addresses were acquired legitimately, legally, you will need to provide information like,
o The date/time they signed up
o The IP address they used to sign up etc.

• Sending emails to such subscribers will most likely result in getting the sender’s IP addresses and the URLs used in the contents blacklisted.

• The result of which will be – the least possible – your email will go straight into the spam folder of the addressee. The worst possible – any emails sent with your URL will bounce back.

• It can take a while to get your IPs used/URLs white-listed and even that is not guaranteed.

• Countries having stringent anti-spam laws like U.S., Canada etc. can get you in trouble if you are not able to prove that the email addresses on your list provided a direct permission to your company to receive emails from you.

• In summary, sending emails to people who never gave you permission to receive emails is not a good idea. It is much better to advertise and build your own list. This way you start from building a sold database of your prospects who may eventually convert.
